Missouri Supreme Court Upholds The Cole County Circuit Court Ruling Striking The MOSIRA Bill Down As Unconstitutional

St. Louis-March 19, 2013-Today, the Supreme Court ruled the so-called Missouri Innovation and Reinvestment Act (MOSIRA) unconstitutional in a decision that confirmed the Cole County Court’s same ruling in February of last year.

Missouri Roundtable For Life, Missouri Right to Life, Lawyers for Life and Missouri Citizens filed suit against the State of Missouri, various state agencies and state employees in Missouri Roundtable For Life, et al. v. State of Missouri, et al., Robin Carnahan, Case No. 11AC-CC00770, because the language of the MOSIRA bill clearly states that MOSIRA does not go into effect without the concurrent passage of the so-called “Aerotropolis” bill. Since the “Aerotropolis” bill did not pass in the special session in the fall of 2011, MOSIRA could not go into effect and was, therefore, a legal nullity.

Governor Nixon had attempted to implement MOSIRA despite its clear unconstitutionality.

The Supreme Court’s unanimous ruling in favor of Missouri Roundtable For Life, Missouri Right to Life, and Lawyers for Life is a clear victory for the citizens and taxpayers of Missouri.

MOSIRA’s clever fraud against Missouri citizens would have enabled special interest groups to seize control of taxpayer dollars. It would have also allowed Missouri tax dollars to fund abortion, human cloning, and embryo-experimentation.

“We are thrilled that the Supreme Court has held both the legislature and the Governor accountable for failing to follow the constitution.” said Fred Sauer of Missouri Roundtable For Life, “We hope that this sends a clear message to both Missouri’s executive and legislative branches that they will be challenged if and when they put special interest groups ahead of Missouri’s hard working taxpayers.”
